You may be entitled to claim damages if your accident compensation solicitor can show that the injury was caused by somebody else’s negligence. Incidents can occur in public or private places. Whether you have been injured as the result of a car accident, industrial injury, slip, trip or fall you may be able to claim compensation however you need to be able to establish that there was “negligence” and you must be able to prove the following:

  • The existence of a “duty of care” between you and the other party.
  • Breach of that duty of care.
  • Damage including financial loss and/or personal injury.
  • That the damage of loss was actually caused by the accident.

If it is proven that negligence occurred causing damage, then you will be entitled to an “award” of compensation. The general idea is to be put back into the position as though the injury never had taken place by the award of a sum of money. The judge will listen to the arguments put forward by your accident claim solicitor and will consider all the circumstances of your case and assess the extent of your loss. Generally, the greater your loss and damage, the more money that you will be entitled to. From a medico-legal perspective, the judge will look at the following factors in determining how much you can claim:

  • Your history relative to the injuries which arose out of the accident
  • The present condition from which you are suffering
  • The results of any medical examinations you may have had before and after the accident
  • The results of any diagnostic procedures including x-ray, pathology etc
  • Diagnosis and prognosis of your condition
  • Whether it is more probable than not that the condition or injuries were caused by the accident
  • Whether your medical condition is stabilised or whether there is any prospect of further improvement or deterioration
  • Whether there is any residual disability, and if so the extent of such disability
  • Whether any further medical or other treatment is indicated and, if so, the probable outcome of such treatment and, if possible an assessment of the cost of that treatment and the period for which you will be unfit for work and/or hospitalised as a result of any such treatments
  • Whether you are fit for any work and if so, what type of work
  • If you are unfit for work, the cause of your loss of capacity for work, the extent for which your are incapacitated, and whether or not such incapacity arises from the accident

If it is alleged that a pre-existing disease or condition has been aggravated, the extent to which the aggravation is continuing, and the effect of the aggravation on your ability to work; whether that disease or degeneration may occur in the future. You may be entitled to accident compensation for:

  • Loss of Earnings
  • Medical, Hospital, Pharmaceutical Expenses
  • Rehabilitation Expenses and Equipment
  • Housing Modifications
  • Adaptive Technologies
  • Nursing Expenses
  • Cost of Gratuitous Domestic Assistance
  • General Damages (Pain and Suffering)
